Welcome to the History of Crestwood Village Community Association
We were developed under the following timeline by CWS LLC (“The Developer”):
08 May 2003: CWS LLC (“The Developer”) filed with the Houston County Probate Court the original Platt of Crestwood Village Subdivision in Plat Book 11, Page 36 (or referenced here).
08 May 2003: CWS LLC filed with the Houston County Probate Court "Restrictions for Crestwood Village Subdivision" which referenced Plat Book 11, Page 36. These restrictions can be found in Probate Court Miscellaneous Book 217, pages 83-87 (or referenced here).
04 November 2005: CWS LLC filed with the Houston County Probate Court a Platt for the “1st Addition to the Crestwood Village Subdivision” in Plat Book 11, Page 75 (or referenced here).
04 November 2005: CWS LLC filed with the Houston County Probate Court "Restrictions for the Crestwood Village Subdivision, First Addition" which referenced Plat Book 11, Page 75. These restrictions can be found in Houston Probate Court Miscellaneous Book 239, pages 100-104 (or referenced here).
07 November 2005: CWS LLC incorporated “The Crestwood Village S/D 1st Addition Community Association" . Along with the Articles of Incorporation, CWS LLC also submitted Bylaws to govern the incorporation. This Corporation’s Bylaws only have authority over lots found in Plat Book 11, page 75 (aka the First Addition). This Incorporation’s founding documents can be found in the Houston Probate Court Corporations Book 111, Page 704-715.
22 April 2008: CWS LLC created a new corporation called “The Crestwood Village Community Association Inc” with corresponding Bylaws which had authority over lots in both Plat Book 11, Page 36 and Book 11, Page 75. This rendered the 2005 incorporation obsolete. The two communities had become one! (These are our Bylaws)
Note: Was this a Merger? No. Did he have the authority to do this? Yes. Click here for more info
Winter/Spring 2019: The 2018-2019 Board solicited ballots from Class A members of the Crestwood Village Community Association.
02 April 2019: The HOA Board received over 50% of the required ballots needed to pass new covenants, but a Special Meeting was never called by the Board to make the motion for new covenants official in accordance with the HOA’s Bylaws (more details here).
03 April 2019: An incorrect “draft” version of the new covenants were submitted to Probate Court and recorded in Miscellaneous Book 356, Page 764 -778 (More details here).
13 May 2020: The corrected “new covenants” voted on by the community members were added to the Houston County Probate Court Miscellaneous Book 367, Page 737-751 (More details here).
NOTE: The "03 April 2019 Covenants" and the "13 May 2020 Covenants" are not considered valid by the current board. (More details here)
So, where did the confusion come from? The HOA Board members are all volunteers. Often, we work long hours at the service of the HOA and its members. Sometimes, we get things wrong and sometimes fail to completely follow through on fixing issues raised by the community members.
There was a question raised on the history of the Crestwood Village Community Association Inc and the validity of the new covenants before the 2021 Annual Meeting. During our 2021 Annual Meeting, the situation become confused further, and the meeting broke down. As a result of this meeting, Officers for the 2021-2022 year were not elected and installed. Consequently, the 2020-2021 Officers remained in office until they appointed their successor to finish their 2021-2022 term. These appointed officers only feel it is right to do what is necessary to keep the lights on and the grass mowed until a new board can be duly elected.
14 June 2022: Annual Meeting was held at First Presbyterian Church Dothan and 2022-2023 Officer were elected.
